What Do Texas Laws Say About the Difference Between Hemp and Cannabis?

The Texas Tribune reports that since lawmakers in Texas authorized some cannabis forms but not others, there is a lot of confusion in prosecution cases.

Here is Texas’ position on cannabis-derived products, while execution varies from city to city.

The amount of THC (Tetrahydrocannabinol) that cannabis and hemp contain differentiates them from one another. Less than 0.3% is considered hemp and is permitted, whereas more than 0.3% is considered marijuana and is banned.

Businesses are permitted to sell CBD, also known as cannabidiol, as long as the THC content is less than 0.3%. CBD is a non-psychoactive component of cannabis. The marijuana plant naturally produces a chemical called Delta-8, which is particularly similar since it may generate a comparable high to marijuana when concentrated.

Polling suggests that Texans support legalizing marijuana and the argument over whether to do so in Texas as in some other states has continued. According to a University of Texas/Texas Tribune poll from June 2018, 84% of state voters planned to support pot legalization.

According to a more recent poll conducted in May 2022 by the Dallas Morning News/UT-Tyler, 83% of Texas voters favor the legalization of marijuana for medical purposes and 60% support its legalization for recreational purposes.
