A federal court has dismissed Manhattan District Attorney Alvin Bragg’s petition for a temporary restraining order and injunction, allowing House Republicans to interrogate former Manhattan prosecutor Mark Pomerantz on the criminal case against former President Donald Trump.

Manhattan District Attorney Alvin Bragg’s Petition

House Republicans will be permitted to interrogate former Manhattan prosecutor Mark Pomerantz over the criminal case against former President Donald Trump, according to a federal judge’s decision. The decision was reached on Wednesday and noted that there was no legitimate reason to overturn the subpoena issued by the House Judiciary Committee. The Manhattan District Attorney Alvin Bragg’s petition for a temporary restraining order and the injunction was denied by Trump-appointed judge Mary Kay Vyskocil.

Judge Vyskocil ruled that the subpoena had been issued by committee head Rep. Jim Jordan, a Republican from Ohio, for a legitimate legislative purpose. She admitted that there were “political dogfights” going on around the issue but said she “does not endorse either side’s agenda.” She urged both parties to come to an understanding over the course of Pomerantz’s deposition.

Previously in charge of the lengthy Trump probe, Mark Pomerantz resigned from his position after a disagreement with Bragg about the case’s course. Pomerantz later published a book on his pursuit of Trump and recently gave appearances for “60 Minutes” and other programs where he highlighted the inquiry. Last Monday, Manhattan District Attorney Alvin Bragg’s petition filed a lawsuit against Jordan and the Judiciary Committee to stop the deposition.

Judge Vyskocil posed challenging questions to the attorneys on both sides during the hearing regarding sovereignty, the separation of powers, and congressional oversight as they relate to the historic indictment. She claimed that she tried to keep the case’s legal aspects and not its political context in mind. Theodore Boutrous, Bragg’s attorney, contended that the subpoenaing of Pomerantz was a “transparent campaign to intimidate and attack” Alvin Bragg’s petition and that Congress was “invading a state” by conducting an investigation into a state prosecutor without having the proper jurisdiction to do so. Vyskocil aggressively grilled Bragg and House Judiciary Committee attorneys.

Matthew Berry, the committee’s attorney, argued in opposition, saying that Congress had good cause to want to question Pomerantz and look into Alvin Bragg’s petition investigation of Trump. In the wake of Trump’s indictment, Republicans proposed legislation that would alter the course of criminal proceedings against past presidents, and Congress is currently examining it. One law would forbid federal monies from being used by prosecutors to look into presidents, and another would mandate that any criminal prosecutions involving a former president be heard in federal court rather than a state court.

Pomerantz came out of the session holding a pile of papers with his book, “People vs. Donald Trump,” but he declined to speak. Alvin Bragg’s petition claimed in his lawsuit that he is taking actions “in response to an unprecedentedly blatant and unconstitutional attack by members of Congress on an ongoing New York State criminal prosecution and investigation of former President Donald J. Trump.” Trump was charged with 34 felonies last month for falsifying business files in connection with hush money payments made during the 2016 campaign to cover up claims of extramarital affairs. At his latest arraignment, he entered a not guilty plea and denied any misconduct.
