Florida Bill is Being Introduced to Make Citizen Arrests Prohibited

A Miami legislator introduced a fresh bill to ban citizen arrests during the current Florida legislative session.

According to its current form, House Bill 25 would make it illegal for civilians who are not law enforcement officials to detain someone they believe to be breaking state regulations. The bill does leave 2 exceptions, though.

When a criminal act is done in front of a law enforcement officer when they are out of their jurisdiction, or when they have reasonable reasons to suspect that a criminal act has been committed, they may make an arrest.

The arrest is lawful until law police arrive for Florida residents who stop someone from breaking into their home, car, or vessel without using excessive force.

HB 25 would go into effect on July 1 if it were to pass. It was put forward on December 23.
